An international divorce is a divorce in which one or both partners have a foreign nationality, you were married abroad, or spouses live in different countries. These variables often makes a divorce more complex, as multiple legal systems and practical rules may play a role.


In an international divorce, it is important to first and foremost get clarity on which law applies, in which country the divorce can be filed, and how agreements concerning, for example, children, finances, and the home are settled.

When do we speak of an international divorce?

  • When you both have a nationality other than Dutch
  • You live in the Netherlands but are not married under Dutch law.
  • You (or one of you) do not speak the Dutch language.
